1. This freight waybill is exclusively for Bangda Enterprise use, prepared by or on behalf of the sender by the Company, and signed and sealed by both the sender and the Company, serving as prima facie evidence of the transport contract.
2. Customs, Export and Import
In providing services to the sender, BD may act on behalf of the sender. BD's liability to the sender under this Agreement is limited to direct losses and shall not exceed the per-kilogram or per-pound limit specified in this clause. As the sender may obtain insurance for special risks in advance, BD shall not bear any other losses or damages (including but not limited to loss of profits, revenue, interest and future business), whether such other losses and damages are special or indirect, and regardless of whether BD knew or should have known of the risk of such losses or damages before or after accepting the express shipment. BD's total liability for any express shipment with a destination outside the territory shall not exceed the actual cash value of the goods.
For fragile items, please pack them properly yourself. Our company shall not be liable for any damage to goods during transit caused by inadequate packaging. Compensation terms: In case of loss or customs detention making the goods unrecoverable, compensation will be made according to the declared value of the goods, but the maximum compensation shall not exceed three times the freight (for insured goods, compensation will be at the discretion of the insured amount; fragile items such as glass products/ceramic products are not eligible for insurance). Documents will be re-sent once. Our company shall not bear any consequential liability for any reason! (Claims will not be accepted after 24 hours following goods receipt).
3. Claim Time Limit
Any claim must be submitted to BD in writing within 24 hours after the goods are signed for and received, otherwise BD shall no longer bear any liability.
4. Cargo Insurance
The insurance premium is charged at 3% of the declared value of the goods, with a minimum charge of USD10 per shipment; (For insured amounts exceeding RMB 20,000, please contact us for consultation)
If the sender fills in the insurance item on the front of the waybill or submits a request for insurance on behalf of the sender through BD's automatic control system, and pays the required insurance premium, BD may insure the goods on behalf of the sender for the loss of the express shipment or damage to the express shipment itself at the actual cash value of the goods. Cargo insurance does not cover indirect losses or damages, nor does it cover losses or damages caused by transport delay.
5. Transport Delay
BD will make reasonable efforts to deliver express shipments according to its normal delivery standards, but these standards are not commitments and do not constitute part of the agreement.
BD shall not be liable for any loss or damage caused by transport delay.
6. Force Majeure
BD shall not be liable for any loss or damage caused by reasons beyond BD's control.
7. Governing Law and Dispute Resolution
In consideration of BD's interests, except where it conflicts with applicable law, all disputes relating to this Agreement shall be subject to the jurisdiction of the courts of the country of original dispatch of the express shipment, and the law of the country of original dispatch shall apply. The sender irrevocably accepts such jurisdiction.
8. Severability
The invalidity or unenforceability of any part of this Agreement shall not affect the validity and enforceability of the other terms.
